Marbella Urban Planning Department is currently working on the legalisation of more than 500 homes.
Developers who had built illegal properties were given the opportunity to pay compensation by the General Plan for Urban Development. This compensation would have consisted of 10% of the benefits received by the developers from the illegal developments and was required under the new plan to legalise some properties. Many home-owners who bought in good faith are at risk of losing their properties and this plan was aimed at helping these owners to legalise their homes.
The payment of compensation had to be made within one year, although the period may now be extended to two. However, in minor cases no period was declared for compensation and promoters have not come forward voluntarily to pay. Therefore the town hall has given them two months to compensate the town hall.
When two months is up the town hall will chase the promoters who have not come forward to demand the compensation.
